Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PropDex, operated by Propdex Pty Ltd (ACN 698 716 077) (“PropDex”, “we”, “us” or “our”). By creating an account, purchasing or generating a report, or otherwise using our website, dashboard, reports or WhatsApp service, you agree to these Terms. If you do not agree, please do not use the service.

1. About PropDex

PropDex provides automated property due-diligence reports for Australian properties, compiled from publicly available government and authoritative data. Reports are information tools to help you understand a property; they are not professional advice (see clause 8).

2. Eligibility and your account

  • You must be at least 18 years old and able to enter into a binding contract.
  • You agree to provide accurate, current and complete information and to keep it up to date.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • Notify us promptly of any unauthorised use of your account.

3. Plans, subscriptions and payment

  • We offer subscription plans and one-off report purchases. The plan, inclusions (such as monthly report allowances), price and any GST are shown at checkout.
  • Payments are processed by our payment provider, Stripe. By subscribing you authorise recurring charges for each billing period until you cancel.
  • Subscriptions renew automatically at the start of each billing period unless cancelled beforehand.
  • Reports generated beyond your plan allowance (“additional” or “overage” reports) are charged at the rate shown at the time.
  • We may change prices, plans or inclusions with reasonable notice; changes apply from your next billing period.

4. Report allowances and use

Monthly report allowances reset at the start of each billing period and do not roll over. Reports are provided for your own due-diligence purposes and are subject to the acceptable-use and intellectual-property terms below.

5. Cancellation and refunds

You can cancel your subscription at any time from your dashboard or the billing portal. Cancellation takes effect at the end of the current billing period. Refunds are governed by our Refund Policy and your rights under the Australian Consumer Law.

6. Acceptable use

You must not:

  • resell, redistribute, sublicense, publish or commercially exploit reports except for your own due-diligence purposes;
  • scrape, copy, harvest or systematically extract data from the service;
  • reverse engineer, decompile or attempt to derive the source code or underlying data structures of the service;
  • use the service unlawfully, to infringe any person’s rights, or to build a competing product or dataset; or
  • interfere with, overload, or attempt to gain unauthorised access to the service or its systems.

7. Intellectual property

We and our licensors own the PropDex platform, software, report templates, design and branding. We grant you a limited, non-exclusive, non-transferable, revocable licence to access the service and to use the reports you purchase for your own personal or internal business due-diligence purposes. Underlying government and third-party data remains subject to its own licences and rights.

8. Reports are information, not advice

PropDex reports are compiled from third-party government and public data sources and are provided for general information only. They are not legal, financial, investment, valuation, planning, building, environmental or taxation advice, and they are not a substitute for professional advice or for formal searches and inspections — such as engaging a solicitor or conveyancer, obtaining a building and pest inspection, a survey, or formal title, planning and council searches. You should independently verify any information before relying on it or making a decision.

9. Accuracy and availability

We compile data from sources we believe to be reliable, but we do not warrant that reports are accurate, complete, current or error-free. The underlying data is created and maintained by third parties (such as government agencies and councils) and may be incomplete, out of date, inconsistent or temporarily unavailable. The service and reports are provided on an “as is” and “as available” basis, and we do not guarantee uninterrupted or error-free access.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Where our goods or services come with guarantees that cannot be excluded, and where the law permits us to limit our liability, our liability for breach of such a guarantee is limited (at our option) to re-supplying the relevant service or report, or paying the cost of having it re-supplied.

11. Limitation of liability

To the maximum extent permitted by law, and subject to clause 10: we are not liable for any indirect, special, incidental or consequential loss, loss of profits, loss of opportunity, or loss arising from your reliance on a report or from errors or omissions in third-party data; and our total aggregate liability arising out of or in connection with the service or any report is limited to the amount you paid us for the relevant report or, for subscriptions, the fees you paid us in the three months before the event giving rise to the claim.

12. Third-party services and links

The service relies on third-party providers and data sources, and may contain links to third-party websites. We are not responsible for the acts, omissions, availability, accuracy or content of those third parties, and links are provided for convenience only.

13. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, liabilities, losses and reasonable costs arising from your breach of these Terms or your misuse of the service or reports, except to the extent caused by us.

14. Suspension and termination

We may suspend or terminate your access if you breach these Terms or where reasonably necessary for security, legal or operational reasons. You may stop using the service at any time. Clauses that by their nature should survive termination — including those on intellectual property, disclaimers, limitation of liability and indemnity — continue to apply.

15. Privacy

We handle your personal information in accordance with our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. The current version, with its effective date, will always be available on this page. Where changes are material we will take reasonable steps to notify you, and your continued use of the service after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
